Purchase Conditions

Product Availability

The formalization of the order implies, in any case, the acceptance of the following purchase conditions. This formalization is understood once the user receives the confirmation email with the details of the purchase.

All orders are subject to product availability. If there are issues with the supply or if products are out of stock, the customer will be informed immediately, and a refund will be processed for the amount of the product or products that are unavailable.

In such cases, the corresponding amount will be refunded without undue delay through the same payment method used for the purchase. If a product is unavailable while others in the same order are, the user will be informed by phone or email about the partial cancellation.

The partial cancellation of an order due to unavailability does not entitle the customer to cancel the entire order. If, due to this cancellation, the customer wishes to return the delivered product, they must follow the guidelines outlined in our Exchange & return policy.

Price

The applicable prices are those indicated on the website at the time of the order.

The prices detailed for each item include VAT (Value Added Tax), IGIC (Canary Islands General Indirect Tax), IPSI (Tax on Production, Services, and Imports in Ceuta and Melilla), or the applicable taxes according to the regulations of the country from which the purchase is made, as appropriate.

If an error is detected in the price of any product the customer has requested before it is shipped, LES GARS reserves the right to promptly correct it. If the correct price is lower than the actual price, the difference will be refunded. If the actual price is higher, the order will be canceled and communicated to the customer via email or phone.

The shipping cost is indicated to the customer at the time of placing the order and can be reviewed in our Shipping policy.

Payment Methods

The user agrees to pay for the purchase at the time of placing the order. The purchase receipt will be available and can be viewed at the end of the website checkout process and in the confirmation email formalizing the purchase, which the user will receive at the email address provided for the purchase.

The user must pay the amount corresponding to their order using any of the enabled methods at the time of purchase, preferably by credit or debit card (Visa, Mastercard, American Express, Visa Electron, and/or other similar cards), or through alternative payment systems: Apple Pay, Google Pay, or Shopify Pay.

For purchases in Spain, the card used for payment must be issued by a Spanish bank or savings bank.

LES GARS has adequate security measures in the sector. Additionally, the payment process operates on a secure server using the SSL (Secure Socket Layer) protocol.

LES GARS states that it does not have access to confidential data related to the payment method used. Only payment gateways and the Google Pay and Apple Pay systems have access to this data for payment and collection management and are inaccessible to other third parties.

The user must notify LES GARS, depending on the country of purchase, of any improper or fraudulent charges on the card used for purchases, by email or phone, as soon as possible so that appropriate actions can be taken.

Shipping Costs

Shipping costs depend on the total amount of the purchase and the delivery point, calculated at the time of purchase.

Shipping costs may be covered by LES GARS if specified as an advantage within a promotion. These free shipping promotions are usually subject to a minimum purchase amount.

In Spain, shipments to the Canary Islands, Ceuta, and Melilla are subject to additional customs and/or import charges in addition to the order amount:

Discount Codes

LES GARS promotions or discount codes are not cumulative and are limited to one per person and per online order. Only one discount code can be used per order and shopping cart, meaning it can be used in a single purchase of one or more products through the website.

Discount codes are non-refundable and cannot be exchanged for cash. The terms and conditions regarding the validity of the code are included with each purchase.

If you have a promotional code, you can use it before completing the order on the same payment screen in the field provided for such use.

In the process of making a purchase, you can enter the promotional code and apply it. In the case of a return or exchange, the code value will not be refunded.

Orders

LES GARS commits to delivering the product in perfect condition to the address specified by the user in the order form. This address may be different from the buyer's address.

To optimize delivery, we appreciate it if the user provides an address where the order can be delivered during regular business hours.

LES GARS will not be responsible for errors in delivery when the delivery address entered by the user in the order form does not match reality or has been omitted.

Right of Withdrawal

The customer has the option to withdraw their order without the need to justify their decision within fourteen (14) natural days from the receipt of the ordered products, with the date on the carrier's receipt signed by the customer as the reference. If the expiration date of this fourteen (14) day period falls on a Saturday, Sunday, or holiday, the period will be extended until the next business day.

The exercise of the right of withdrawal must be done through an email addressed to hello@les-gars.com, indicating the intention to return the order. It is also informed that the customer has a form to exercise the right of withdrawal in the Contact section of the website and all instructions regarding the return of a product in our returns and exchanges policy.

The exercise by the consumer and/or user of the right of withdrawal entails the automatic termination of the contract for the consumer and, therefore, the refund by LES GARS of the amounts paid by the consumer and user, without retention of expenses, except for shipping costs arising from the transfer of the garment from the warehouse to the customer's home or any other cost related to customs or transportation as such.

The refund of these amounts will be made without undue delay and, in any case, before 14 natural days have elapsed from the date LES GARS was informed of the consumer and user's decision to withdraw from the contract.

The exercise of the right of withdrawal entails the obligation for the consumer to return the product, in the same conditions in which it was received, no later than 14 natural days from the date they communicated their decision to withdraw from the contract. Therefore, LES GARS may withhold the refund until receiving the goods at its offices or the indicated location.

To exercise the right of withdrawal, the product must be returned in the same conditions as received. No refund will be made in cases where the product is in different conditions or has suffered any deterioration or impairment.
